En cualquier momento podrá ejercitar los derechos establecidos en los artículos 15 a 22 del Reglamento General de Protección de Datos de la UE (RGPD), en consecuencia tiene derecho a solicitar al responsable del tratamiento el acceso a sus datos personales, y su rectificación o supresión, o la limitación de su tratamiento, o a oponerse al tratamiento, así como el derecho a la portabilidad de los datos, mediante un escrito, acreditando su personalidad, dirigido a TYRIS-SOFTWARE S.L., Av. Asimismo le informamos que conforme a lo estipulado por el RGPD en su artículo 13.1 d), el interés legítimo perseguido por el responsable del tratamiento que legítima o legaliza el tratamiento de sus datos personales es la ejecución de un pacto o contrato verbal o por escrito, siempre y cuando sobre dichos intereses no prevalezcan los intereses o derechos y libertades fundamentales del interesado o afectado.

Respecto al plazo temporal de conservación de sus datos personales, le informamos que éstos serán conservados mientras sean necesarios o pertinentes para la finalidad para la cual hubieran sido recabados o registrados. Por lo tanto se procederá a su cancelación cuando éstos hayan dejado de ser necesarios para cumplir con las finalidades legítimas descritas anteriormente. Conforme a lo estipulado por el artículo 13.2. c) del RGPD le comunicamos la existencia del derecho a retirar su consentimiento para el tratamiento de sus datos personales, sin que ello afecte a la licitud del tratamiento basado en el consentimiento previo a su retirada.

Asimismo también le informamos de su derecho a presentar en su caso una reclamación ante la autoridad de control nacional (Agencia Española de Protección de Datos – AEPD).


EL USUARIO entiende que la información contenida en la URL, tanto en referencia a las especificaciones de los servicios ofrecidos en la web, como a las condiciones generales de contratación y perfeccionamiento del contrato, son bastantes y suficientes para la exclusión de error en la formación del consentimiento.

No obstante TYRIS-SOFTWARE se compromete a poner en conocimiento de la EL USUARIO cualquier otra especificación técnica o jurídica de los servicios, a primer requerimiento por cualquier medio que deje constancia; ello siempre y cuando estén a disposición de la primera.


TYRIS-SOFTWARE tiene su sede social y su establecimiento físico en Av. Manuel Candela 2-37, 46022-Valencia


TYRIS-SOFTWARE garantiza que los datos personales del USUARIO, consignados en el formulario de registro y en el formulario de pedido, solo se utilizarán para la ejecución del presente contrato.

Del mismo modo, el CLIENTE autoriza expresamente a v a tratar de forma automatizada los datos personales indicados en el formulario, con las finalidades que se desprendan de forma directa de la relación contractual establecida con TYRIS-SOFTWARE, y ello con los límites derivados de la prestación contratada. 

En cualquier caso, el USUARIO podrá dirigirse en cualquier momento a TYRIS-SOFTWARE con el fin de acceder, rectificar o cancelar los datos indicados.


TYRIS-SOFTWARE se compromete a que todas las transferencias de datos que se efectúen a través de su URL se realizarán bajo Servidor Seguro; de tal modo que la información se transmite de forma encriptada y es inaccesible para cualquier otra persona.

Ambas partes se comprometen expresamente a la conservación de todas las informaciones cruzadas entre ellas, ya sea a través de la URL de TYRIS-SOFTWARE o a través de e-mail, como prueba de las transacciones realizadas.


Las presentes condiciones generales de contratación pasarán a formar parte del contrato en el momento de aceptación de las mismas, la cual se verificará por medio de un “click” en el botón correspondiente.

El USUARIO tiene la obligación de remitir copia firmada del presente contrato, en papel bien sea por correo ordinario o por fax y en un plazo estipulado de 15 días.

El USUARIO afirma que entiende y acepta las presente condiciones generales, y sus correspondientes particulares, que integran el contrato, en el momento de su contratación electrónica.


Ambas partes declaran expresamente que la aceptación de las presentes condiciones generales de contratación por EL USUARIO se lleva a cabo a través de la pulsación del botón correspondiente al pié de la pantalla en la que aparecen las mismas.

Del mismo modo, el mero hecho de rellenar el formulario de pedido por EL USUARIO supone la aceptación integra y expresa de las presentes condiciones generales.


El USUARIO autoriza a TYRIS-SOFTWARE a modificar las condiciones de prestación del servicio siempre que obedezca a razones objetivas que reviertan en una mayor eficiencia en la prestación del servicio a favor del USUARIO, lo cual le será comunicado por los canales habituales de comunicación entre ambas partes, y con la suficiente antelación. A este respecto, el USUARIO comunicará a TYRIS-SOFTWARE en un plazo de 15 días la aceptación, en su caso, de las modificaciones de prestación del servicio, sin perjuicio de su derecho a rescindir el contrato si las mismas resultaren muy divergentes con las inicialmente estipuladas.


El USUARIO acepta que no utilizará estos servicios con propósitos ilegales, ni interferirá ni perjudicará las comunicaciones de otros usuarios a redes conectados a este servicio.

Igualmente acepta que el uso de estos servicios deberá sujetarse a las políticas relacionadas con las comunicaciones a través de Internet, aprobadas por las organizaciones internacionales competentes.

El USUARIO se obliga a indemnizar por los daños irrogados a TYRIS-SOFTWARE derivados de la incorrecta utilización de los servicios o uso del mismo contraviniendo los términos de este contrato. Asimismo, responderá frente a terceros por las lesiones que ocasiones en sus derechos.


Ambas partes reconocen que la legislación aplicable al presente contrato, y a todas las relaciones jurídicas dimanantes del mismo, será la española, por expresa aplicación de lo dispuesto en el artículo 1.262 del Código Civil, en relación a lo dispuesto en el Capítulo IV, del Título Preliminar del mismo cuerpo legal.

Igualmente, ambas partes declaran que el presente contrato no está sujeto a la Convención de Naciones Unidas sobre contratos de compraventa internacional, firmada en Viena el 11 de Abril de 1.980, por no tratarse de operaciones de índole mercantil, sino de compraventa de consumo.
